Andaya asks Sandiganbayan to ignore calls to suspend him: Sino ba sila?
House Majority Floor Leader and Camarines Sur Representative Rolando Andaya Jr. has asked the Sandiganbayan 3rd Division to ignore calls for his suspension.
Andaya has filed a comment telling the anti-graft court to junk the letters filed by several individuals prodding the 3rd Division to suspend him.
The legislator pointed out that these persons “do not have standing in these criminal cases.”
Andaya is facing before the Sandiganbayan 97 counts of graft, 97 counts of malversation in connection with his alleged involvement in the Malampaya fund scam.
“Considering that this Honorable Court has yet to conduct any pre-suspension hearing, and considering further the pendency of the Motion for Bill of Particulars dated February 20, 2018 and the motion for reconsideration dated August 28, 2018, the call for the accused’s preventive suspension is premature and devoid of legal basis,” he pointed out.
Under the charges, he and his co-defendants are accused of having illegally diverted P900 million from the Malampaya fund allocated by the Department of Budget and Management (DBM) to the Department of Agrarian Reform (DAR) between 2009 to 2010. At that time he was DBM secretary.
They allegedly used non-government organizations (NGOs) under alleged pork barrel scam brains Janet Lim Napoles as conduits.
The funds were meant to be used for relief operations, rehabilitation, and reconstruction of areas affected by typhoons Ondoy and Pepeng.
