Calida asks SC to drop Duterte as respondent in martila law suit: He’s immune
Solicitor General Jose Calida on Monday, June 19, has asked the Supreme Court (SC) to drop the name of President Rodrigo Duterte as a respondent in the petitions seeking the nullification of martial law declared over Mindanao.
“Petitioners cannot be permitted to disregard the doctrine of presidential immunity,” read his memorandum filed before the SC on Monday (June 19).
“Without any waiver of his immunity from suit, President Duterte should be dropped as a party-respondent,” he pointed out.
Calida reminded the high tribunal that it has repeatedly ruled the President “may not be sued in any civil or criminal case, and there is no need to provide for it in the Constitution or law.”
