Walang kawala! Guevarra: Legislative immunity can’t protect Trillanes
Justice Secretary Menardo Guevarra has schooled Senator Antonio Trillanes IV and remineded the lawmaker that he cannot invoke legislative immunity from arrest.
“It’s not applicable,” Guevarra said after learning that Trillanes claimed that he cannot be arrested even after his amnesty got voided.
The Secretary noted that the Constitution gives members of congress the privilege of not being arrested while congress is in session.
“It will apply if the offense charged is punishable by an imprisonment of not more than six years. So yun lang ang applicable yung privilege na yun if the offense carries a penalty not exceeding six years,” he said.
“But coup d’etat carries the penalty of life imprisonment and for that reason is not bailable,” he reminded.
Prior being granted amnesty, Trillanes is facing charges including coup d’etat before the Makati regional trial court over his involvement in the Oakwood mutiny and Manila Peninsula siege.
However, President Rodrigo Duterte has issued a proclamation which voided the amnesty given to Trillanes.
