Abusadong OIC? Ombudsman urged to file criminal charges, suspension of Mancile, Sereno for usurping powers in PPA
An employee of the Philippine Ports Authority is urging the Office of the Ombudsman to file criminal charges and suspend two OIC officials in his agency for usurpation of authority.
In a complaint filed with the Deputy Ombudsman for Luzon, Genaro P. Mancio Jr. claimed acting PPA General Manager Francisquiel O. Mancile abused his authority when he issued Special Order (SO)2022 reassigning PPA police staff, specifically Sesenio B. Sereno III from acting Division Manager for Intelligence to acting Department Manager (police superintendent) on September 21.
Mancio said the division heads of PPA human resources and legal, Abogados Mark Palomar and Rigel Caabay, warned Mancile that he did not have the authority to reassign Sereno.
But Mancile ignored the advice of PPA abogados while Sereno assumed his new post despite being aware of he irregularity of SO 2022.
Mancio said Transportation Secretary Jaime Bautista did not grant additional powers when he named Mancile, PPA Assistant General Manager, as Officer-in-Charge of the PPA in an SO issued in July 25. (Christopher “Chet” Pastrana inexplicably did not assume the GM post despite reports of his appointment by President Bongbong Marcos.)
Mancio said Bautista’s SO expressly directed Mancile to merely perform his role as OIC which, under Civil Service Commission rules, does not include the power to appoint employees.
Mancio asked the Ombudsman to file criminal charges against Mancile and Sereno.
He urged the Ombudsman to file an administrative case against Mancile for betrayal of public trust, grave misconduct and conduct prejudicial to the service.
Mancio also sought a preventive suspension of both Mancile and Sereno not only because their continued stay in office might prejudice the case filed against them, but also because they have shown propensity to disregard rules and regulations.
Mancile is the first Marcos appointee to be the subject of an Ombudsman case.
