Aguirre should resign if he can’t reverse exoneration of Espinosa, Lim – Gordon


Senator Richard Gordon on Tuesday said Justice (DOJ) Sec. Vitaliano Aguirre II should consider resigning from his post if he cannot overturn the dismissal of the case recommended by the prosecution panel on the drug charges against self-confessed drug dealer Kerwin Espinosa, alleged drug lord Peter Lim, and other suspects.

“Ngayon pa lang kaduda-duda na eh,” he said referring to the DOJ resolution reported to have been approved by acting Prosecutor General Jorge Catalan last Dec. 20 but made known to the media only recently.

Gordon dared Aguirre to rise to the occasion and prove critics wrong.

“Aba’y magpakatotoo ka. Unang una, importante na kaso ito lalo na ang policy ng Presidente natin ay labanan ang droga. Pangalawa magpakatunay kang abogado. Gamitin mo yung pagka abogado mo para i file yung kaso na dapat i-file,” he said.

Gordon noted that no less than Espinosa himself confessed to senators that he has been engaged in peddling illegal drugs while detained inside the New Bilibid Prisons (NBP), including supposed payoffs to ranking police officers.

“At kinuwento nya buhay sa droga nung nakakulong sya. Sinundan nya yung malalaking tao sa preso, nakisosyo na sya,” the senator said.

“Kaya nga ang tingin ko, ako as a lawyer, guilty. Lahat naman ng nire-ecommend namin guilty, pati nga ‘yung sila (former BOC Comm. Nicanor) Faeldon. Bakit dinismiss yung kaso?” Gordon was referring to the similar dismissal of the charges filed against the former BOC chief in relation to his alleged involvement in the smuggling of shabu worth P6.4 billion.

The dismissal was allegedly brought about by legal technicalities and Gordon could not help but raise suspicions on these recent developments.

“Para bang sinasadya eh. Pagka ganyan hingin ko na resignation ni Sec. Aguirre,” he said.

But the senator said he’s still giving Aguirre the benefit of the doubt and expect the Cabinet official to reverse the prosecution panel’s recommendation.

“Pagka masyadong masidhi ang galit ng tao baka ire reverse ‘yan,” he said.
