Carpio wants VP poll protest junked: Panalo na si Leni!
Supreme Court (SC) Justice Antonio Carpio said on Friday (Oct.18) the Supreme Court (SC), sitting as Presidential Electoral Tribunal (PET) should have dismissed the electoral protest of former senator Ferdinand “Bongbong” Marcos Jr. against Vice President Leni Robredo.
Instead, the PET last October 15 asked the parties to comment on the results of the recount of the 2016 vice presidential polls in the pilot provinces of Camarines Sur, Iloilo and Negros Oriental.
Carpio disagreed with the move of the PET based on the majority of vote of the justices and even wrote his dissent on the matter.
“It’s there in my dissent that in Rule 65 (PET Rules), if the protestant cannot make any substantial recovery then the protest will be dismissed,” he told reporters.
“That has been the rule ever since,” he pointed out.
In the same order, the PET also directed the parties “to submit a memoranda on the various issues relating to the jurisdiction and other matters relating to third cause of action, which is the annulment of election results for Vice President in the provinces of Lanao Del Sur, Basilan, and Maguindanao.”
