Chiz: Imelda is not qualified for presidential pardon — for now
Former First Lady Imelda Marcos won’t be eligible for a pardon from President Rodrigo Duterte, according to Senator Chiz Escudero.
In an interview with reporters, the senator said the President would not be able to pardon Marcos, who was convicted on graft charges by the Sandiganbayan last week.
“Wala, kasi disqualified para makatanggap ng presidential pardon si dating Unang Ginang Imelda Marcos. Disqualified siya dahil may kaso pa siya at inapela pa nya,” explained Escudero, a lawyer.
He said a basic requirement for a presidential pardon was the convict should not have any pending case or pending appeal.
“Dapat final ang conviction kahit na sino ang maikunsidera bago pa umabot sa mesa ng Pangulo, so sa ngayon wala pang pardon na pinag uusapan dahil inilalaban pa ang kaso,” Escudero said.
He also defended the Philippine National Police for not immediately arresting Marcos as soon as the decision was promulgated.
“Di pa rin pwede arestuhin kasi wala naman warrant of arrest. Out on bail yata sya. Hindi naman pinag-utos ng korte na sya ay arestuhin. At di pa final. Sa ngayon walang order of arrest na pag uusapan para timbangin ni gen albayalde kung aarestuhin ba o hindi,” Escudero said.
He also said Marcos’ conviction should have no effect on her candidacy for governor of Ilocos Norte in the 2019 midterm elections.
“Wala rin dahil conviction by final judgment lang ang pwedeng magdisqualified sa isang kandidato,” Escudero said.
