The Department of National Defense (DND) can’t unilaterally terminate its accord with the University of the Philippines (UP), Free Legal Assistance Group (FLAG) chairperson Chel Diokno said.
“Malinaw sa Article 1308 ng Civil Code: contracts ‘bind both contracting parties, its validity or compliance cannot be left to the will of one of them’,” he said in his recent social media post.
Because of this, the lawyer advised the DND against violating the country’s laws.
“Sana imbis ng maghigpit ng mga estudyante, sumunod sa batas ang DND,” Diokno said.
“Hindi nila pwede basta i-terminate ang UP-DND accord,” he added.
DND Sec. Delfin Lorenzana wrote to UP President Danilo Concepcion that the agreement has been terminated starting Jan. 15 since the university has been used as recruitment for communist groups.
Lorenzana complained the government could not take action because of the accord which prevented state forces from entering UP campuses.
