DOJ prosecutors to file graft raps vs. Albayalde soon
Prosecutor General Benedicto Malcontento has assured that the graft case against retired Philippine National Police (PNP) chief Oscar Albayalde will be filed before the Office of the Ombudsman within the month.
“We will definitely submit the indorsement this month,” he said.
Once filed, Malcontento said he will leave it up to the Ombudsman whether to adopt the findings of the Department of Justice (DOJ) panel of prosecutors who conducted the preliminary investigation of the case.
“It’s their option whether they can adopt or conduct their own,” he said.
Recently, a DOJ panel of prosecutors issued a resolution which found probable cause to indict Albayalde with graft concerning his involvement with the so-called “ninja cops” in the questionable 2013 drug operation in Mexico, Pampanga.
“The Panel anchored its finding on Albayalde’s non-implementation of an Order which sought to penalize the police officers involved in the questioned drug operations,” the DOJ said.
