Police Lieutenant Colonel Bahnarin Kamaong, one of the accused in the 2009 Maguindanao massacre, has asked the Court of Appeals (CA) to order Quezon City Judge Jocelyn Solis-Reyes to release him from detention.

In his petition seeking the issuance of a writ of habeas corpus, Kamaong told the CA that Reyes has yet to act on his motion for immediate release.

“Thus, petitioner Kamaong’s continuous detention is considered illegal, arbitrary and inhumane,” read his habeas corpus petition,” read his petition.

Kamaong pointed out his “continuous incarceration despite acquittal is inconsistent with the Order given in open court on Dec. 19, 2019.”

Last December 19, Reyes promulgated the decision which found 28 principal accused including Kamaong guilty of 57 counts of murder.

However, the same decision also acquitted him from the 57 counts of murder.

Because of this, his lawyer sought during the promulgation of the case for clarification.
