Resigned National Youth Commission (NYC) chair Ronald Gian Carlo Carderma branded himself as “incoming congressman” even though his petition for substitution as primary nominee of Duterte Youth Partylist has not been approved yet by the Commission on Elections (Comelec).

In his Facebook post dated May 16, Cardema said he was now an “incoming” member of the House of Representatives although the poll body’s en banc hasn’t come up yet with a resolution on whether or not they will allow the separate petitions for withdrawal and substitution of the partylist group.

COMELEC Director France Arabe said that as of Sunday, Cardema’s petition for substitution and Duterte Youth’s petition for withdrawal are still pending before the en banc.

On Saturday, COMELEC clarified that Cardema is not yet disqualified as substitute nominee of Duterte Youth Partylist since the actual deadline for filing of substitution for partylist is “on the day of the election” itself and not on November 29, 2018 as per earlier reported.

Cardema, according to Arabe, filed his petition for substitution at the COMELEC Law Department on the eve of Election, May 12 and not May 16 according to Kabataan Part-ylist Rep. Sara Elago.

Based on the partial and unofficial results from the COMELEC’s transparency server, Duterte Youth already has 346,314 votes based on 86,321 of 87,851 clustered precincts transmitted and currently ranked 21st in the overall tally.

Arabe earlier explained the situation of the Duterte Youth party-list was not only a simple case of substitution since the group has also withdrawn the nomination of all the five of its nominees, including Cardema’s wife Ducielle Marie Suarez Cardema.

Duterte Youth’s action already happened before in the past according to the poll body official and it is allowed under the Party-list Law for as long the new sets of nominees have complied with the requirements.

On Sunday Chief Presidential Legal Counsel and Presidential Spokesman Salvador Panelo said Cardema was deemed resigned as chair of NYC the moment he filed his petition for substitution before the polls body’s en banc.
