Here’s a good question from Supreme Court (SC) Justice Alfredo Benjamin Caguioa to the anti-Marcos hero’s burial petitioners: Why not ask President Rodrigo Duterte to stop the burial?
During the oral arguments held Wednesday (August 31) by the Supreme Court (SC) on the issue, Justice Caguioa wondered why the petitioners opposed to the interment chose to bring the matter to the High Court.
“Do you recognize the remedy available in the Office of the President?” he asked.
To which, National Union of People’s Lawyers (NULP) secretary general Ephraim Cortez replied, “the remedies are not speedy and adequate enough to provide immediate relief.”
Justice Marvic Leonen didn’t even appear sure if the SC had jurisdiction over the issue, and in effect entertain the petitions against late dictator Ferdinand Marcos’s burial at the Libingan ng mga Bayani (LNMB).
Since the President has discretion over who gets buried at the LNMB, Leonen pointed out that the SC can only act on grave abuse of discretion.
President Duterte was the one who green-lit Marcos’ burial there in the first place.
