PNP’s wish is our command: Guevarra says DOJ to work on barring Mayor Baldo from fleeing PH
Justice Secretary Menardo Guevarra on Saturday (Jan. 5) has assured that the Department of Justice (DOJ) will act on the request of the Philippine National Police (PNP) to prevent Daraga, Albay Mayor Carlwyn Baldo from fleeing the country.
Guevarra made the assurance after the PNP took in custody the alleged gunmen who tagged Baldo as the brains behind the killing of Ako Bicol party-list Rep. Rodel Batocabe.
“The DOJ has received the request for issuance of an ILBO (Immigration Lookout Bulletin Order) against Mayor Baldo,” Guevarra said.
“We shall take such action as may be appropriate,” he assured.
The Supreme Court (SC) has already ruled as unlawful for the DOJ to order the issuance of an ILBO.
In its place, the SC said the DOJ can seek a precautional hold departure order (PHDO) before a court while any case against Baldo is undergoing a preliminary investigation before the DOJ or any prosecutor’s offices.
A court can only issue a HDO if Baldo has been indicted after prosecutors found probable cause in the conduct of the preliminary investigation and orders the filing of charges.
