Palace Spokesman Harry Roque believes the petition asking the Supreme Court to compel the President to release all his health records will be dismissed.
“Ang aking fearless prediction, madi-dismiss po yan but we welcome the opportunity of this petition (because this will) build jurisprudence, to make jurisprudence, and define specifically the obligation of the President in case of an illness,” Roque said during the Laging Handa public briefing Tuesday.
The abogado said the Constitution only requires the disclosure of the president’s health in case of serious illness.
“Malinaw po ang sabi ng Saligang Batas, kinakailangan kung meron kang serious illness ay kinakailangan i-report ng presidente ito sa taumbayan. Ang preidente nag desisyon na kung meron siyang karamdaman ito’y karamdaman ng lahat ng 75 year old ay meron din. Kaya ang tingin niya hindi po ito serious illness at hindi kinakailangan i-report sa taumbayan,” according to Roque.
The spokesman also pointed out that Duterte is “absolutely” immune from any criminal, civil and administrative suit during his six-year term.
“Ako po nung panahon na ako’y mahilig magsampa rin ng kaso sa Supreme Court, David vs. Arroyo, malinaw po ang sabi ng ating Korte Suprema, hindi mo pupuwedeng idemanda ang Presidente, kahit anong demanda yan habang siya ay presidente,” he added.
