Sa maling korte dinala: SC junks petitions vs. provincial bus ban
The Supreme Court (SC) has dismissed the petitions of congressmen who wanted to stop ban imposed by the Metropolitan Manila Development Authority (MMDA) against provincial bus terminals along EDSA.
“We dismiss the suit for contravening the doctrine of hierarchy of courts,” read the SC’s ruling.
The SC reminded that it is “a court of last resort” and “direct resort to this Court through a certiorari petition can only be obtained in cases raising strictly legal questions.”
“The issue whether the ban of provincial bus terminals along EDSA eases traffic congestion is likewise factual in that it requires showing verified data or statistics,” the SC said.
“These factual questions require reception of evidence and/or hearing which must be relegated to the Court of Appeals or to the proper trial court,” it added.
There were three petitions that were filed and eventually consolidated by the SC.
The petitions were filed by Albay 2nd District Rep. Joey Salceda, the petition from the group led by Bayan Muna party-list Rep. Carloz Zarate, and the petition from Ako Bicol party-list.
