Sandiganbayan allows ex-MRT 3 GM Vitangcol to move for dismissal of cases


The Sandiganbayan 6th Division has granted the motion of former Metro Rail Transit 3(MRT 3) general manager Al Sanchez Vitangcol III who sought leave to file a demurrer which challenges the evidence presented by the prosecution during the trial.

“After carefully weighing the arguments offered by the prosecution and the accused-movants, the court resolves to grant the motion for leave of court to file demurrer to evidence filed by accused Vitangcol,” read the anti-graft court’s resolution.

“To the mind of the court, the motions for leave to file demurrer in this case were filed not for the purpose of delaying the proceedings but appears to be based on accused’s sincere belief that the prosecution’s evidence failed to prove beyond reasonable doubt that they were guilty of violating Section 3(b) of R.A. No. 3019,” it pointed out.

With this, the court gave him 10 days from notice to file his demurrer to evidence.

Vitangcol is facing two counts of graft before the 6th Division concerning allegations of extorting 430 million in 2012 from Inekon for it to be selected as supplier Light Rail Vehicles (LRVs) under Lot 1 of the MRT3 Capacity Expansion Project.
