Sandiganbayan rejects ex-Napocor exec’s plea to file demurrer
The Sandiganbayan 2nd Division has refused to allow former National Power Corporation (NAPOCOR) executive Alberto Guanzon leave to file a demurrer to evidence which will challenge the evidence presented against him during the trial.
In its resolution, the anti-graft court told Guanzon, the former chief of NAPOCOR’s Contract Expiration on Insurance Capacities, should present his defense instead during the trial.
“After a meticulous review of the records, the court finds that the evidence adduced by the prosecution, testimonial and documentary, as well as the admission and stipulations on record, are prima facie sufficient for conviction of accused Guanzon of the crimes charged, unless successfully rebutted by defense evidence,” it ruled.
Guanzon is facing two counts of graft and malversation along with his co-accused former NAPOCOR president Rogelio Murga.
Under the case, the two accused allegedly released a total of P124.4 million in NAPOCOR funds in 2003 without authority.
