Sandiganbayan rejects Pichay’s plea to file demurrer


The Sandiganbayan 5th Division has remain firm in denying the motion of Deputy Speaker Prospero Pichay Jr. who sought leave to file a demurrer to evidence concerning charges over a 2010 chess tournament sponsored by the Local Water Utilities Administration (LWUA).

“Wherefore, premises considered, the court hereby resolves to deny the instant motion for reconsideration. The assailed resolution dated October 17, 2018 stands,” ruled the anti-graft court against his motion for reconsideration.

“The issues and arguments posed by the accused were already raised and passed upon in the said resolution,” it added.

Because of this, Pichay will have to present his defense during the trial of the case since the prosecution has already wrapped up its presentation of evidence during trial.

Pichay has been charged with graft and violation of the Code of Conduct for Public Officials and Employees.

The case stemmed from LWUA’s sponsorship of the 2nd Chairman Prospero Pichay Jr. Cup International Chess Championship of the National Chess Federation of the Philippines (NCFP).

At that time, Pichay was both LWUA chairman and NCFP president.

The Office of the Ombudsman which filed the charges discovered that Pichay allocated P1.5 million for the event from the funds of the LWUA even though this was not part of the LWUA’s functions.
