The camp of Supreme Court (SC) Chief Justice Maria Lourdes Sereno claim she can bypass a fellow magistrate who has been assigned to act on the temporary restraining order (TRO).
During her testimony at the impeachment proceedings in Congress against Sereno, SC Justice Teresita Leonardo-De Castro said she was supposed to be the ponente of the TRO based on the petition filed by the party-list Coalition of Senior Citizens in the Philippines which got disqualified by the Commission on Elections (Comelec) back in 2013.
De Castro testified tat Sereno issued her own TRO and ignored the former’s recommendation without making consultations.
De Castro recommended the TRO be issued to prevent the Comelec from implementing its resolution to disqualified the party-list, while, Sereno’s TRO prevented the Comelec from further proclaiming winners from among the party-list candidates.
Sereno’s camp pointed that the party-list filed its petition when the SC was in recess.
