Former senator Antonio Trillanes IV has asked a Department of Justice (DOJ) panel of prosecutors on Tuesday (Oct. 22) to dismiss the criminal complaint filed against him by Davao-based businesswoman Guillermina Barrido.
In his counter-affidavit, Trillanes said the complaint should be dismissed “for utter lack of merit and/or lack of cause of action and for lack of evidence.”
Trillanes is facing before the DOJ a complaint filed by Barrido who accused her kidnapping and serious illegal detention as she alleged she was held against her will in December 2016 while being forced to sign false statements against President Rodrigo Duterte.
“Kindly note that, a large part of the ‘evidence’ submitted MS. BARRIDO in support of her AFFIDAVIT and SWORN STATEMENT in this case consists primarily of snapshots of the screens of her cellphones, including pictures of text messages, emails and/or correspondences which purportedly took place while she was at the convents from December 6, to 21, 2016. Hence, it is confirmed that her cellphones were with her and was in fact working at that time,” the former senator pointed out.
“Please note that, out of the numerous of screenshots of texts, email messages and/or correspondences that MS. BARRIDO submitted with her AFFIDAVIT and/or SWORN STATEMENT, including those written in Visayan, not a single one contained a report or complaint to anyone that she is being ‘detained’ against will or she was being ‘treated like a prisoner’ at the wherever she was staying,” he added.
Trillanes also denied allegations that prior her detention they met eight times to discuss the false testimony she was going to make against Duterte.
“I have never ever met or seen Ms. Barrido before, nor have I ever spoken or in any way communicated or corresponded with her before,”
He pointed out that she showed one picture of him as proof of the meetings but he pointed out it was stolen from a Facebook account from an overseas Filipino worker and was taken in Paris, France in June 2017.
Also, he was in the United States when she said they met in the Mall of Asia in Pasay City on November 15, 2016.
Trillanes said that “on November 15, 2016 or any other date at or around said date because herein Respondent was actually abroad, specifically in the United States of America from November 6 to 26, 2016.”
