Retired Supreme Court (SC) Justice Antonio Carpio on Tuesday (April 20) assured President Rodrigo Duterte that the United Nations (UN) can order China to leave the West Philippine Sea (WPS).

“Getting a UN resolution in your country’s favor is already a huge victory because that means the world community is behind your country,” Carpio said.

“That strengthens enormously your country’s position and weakens greatly your adversary’s position,” he added.

The retired magistrate told Duterte this is “how a country defends its national interest.”

“A country cannot just fold up and give up just because the other side is stubborn. That is a childish mentality,” he stated.

Carpio made raised this point after Duterte publicly asked the retired magistrate: “If the United Nations will ask China to surrender because of that award given to us, will China give it?”

It can be recalled that in July 2016 the Philippines secured against China a favorable ruling from the Permanent Court of Arbitration in the Hague Netherlands which stated that China’s claims over the WPS do not comply with international law and the United Nations Convention on the Law of the Sea (UNCLOS).
